RE: RedNeck Mulisha web site

Postby PITBULL » Fri Apr 09, 2010 4:09 pm

To all of you for taking the time to comment of The RedNeck Mulisha web site……

Although our team has had it struggles in the past we are moving forward to improve, and regain the respect of that which we have lost. We are well aware of the past situations and are taken steps to mend those past mishaps. Those who have been involved have, or are dealing with, correcting any further potent ional problems. Our team goal is to focus on the future. We have learned from our mistakes, and want to get back to what matters. That is the love of this sport!
As far as the pictures…….These are pictures of the players in RedNeck Mulisha. This is a team website. There are different places, and fields that are featured in these pictures. They were not posted to piss anyone off. We are simply trying to show what our involvement is with air soft, and what air soft looks like. There are many people interested in the sport. Sharing these photo’s that are posted is a good thing for all of us, as we are sure that all of our goals are the same……Help the air soft communities grow so that we can achieve the highest success.
So, copyright is not our intent (we are not trying to make money off the work of anyone else), FYI: Photos of recognizable individuals should only really be used (at least commercially and/or for wide publication) with a signed release form, if nothing else so that the person understands what might happen and so that you can show that you informed them. (I don’t believe that any of our team sign a release form, so are we wrong to post them on our website?)
So, good or bad whatever your opinion is…..many we have played with respect our skills on the field, and have said they would play with our team anytime. Everyone has their own opinions, we hope that the air soft communities will live for the future and not the past. If you are interested in our field and want to play we look forward to hearing from you. Money donations are accepted for playing, however two can foods are required, as we are helping collect food to support our local food banks and shelters.

As good as it sounds... the thread was closed for a reason... your post will just incur negative opinions of said team.

Really? Tim and Josh (members of my team, mind you, not yours) signed a release form to you? Why are my team members on your asstastic website? They certainly aren't on your team, and I highly doubt they signed anything you put in front of them.

In my defense as a photographer, the AP waiver provides a photo release:

"6. I hereby grant permission to AIRSOFT PACIFIC to use my photographic likeness in all forms and media for advertising, trade, and any other lawful purposes."

I can't speak for any other waivers, but quite a few organizations are putting a talent release in their liability waivers. I know that the Boy Scouts of America have buried their talent release in the medical form required for all events. You should no longer assume that an event organizer will explicitly and separately have you sign a talent release.

Enough about that side of the coin.

As a photographer, my concerns regarding the distribution of my photos is limited to being credited for my work. I don't charge for my photos, except when an event organizer is kind enough to offer a stipend for my travel expenses and/or meals. The AP community enjoys a wonderful set of photographers and videographers who often work for dust and spiders, and the least we can ask for is that individuals using our work credit us for it. Several of them are doing this stuff professionally and could choose to make your life painful if they were so inclined.

As for myself, I've been contacted by more than one individual in this community and quite a few publications, and been more than happy to grant a "hominus dominus" over the usage. If I have to go back and watermark all of my photos to make the crediting more explicit, then I will do so, but to date, I've operated under the assumption that people will ask nicely first.

But Wombat, that waiver is for Airsoft Pacific. I don't read too good but I can't see where it says anyone can use the photos for their own interests.

It seems the best thing you could do at this time is removing said photos and move forward. Starting further threads seems like a good idea but probably bought as wise as a one legged man participating in an a$$ kicking contest. Words and websites are one thing but nothing beats actual results.

BLEAT!

Can you pride-princesses find something less gay to cry about then your picture being on the Internet, again -- which you're secretly flattered about anyway.

For the record - I never said they had to remove any photos. Half of you guys save the photos and publish them on your facebook page anyway. I could care less, they have watermarks on them for a reason. People know they came from AP because they have an AP on them. Pretty self explanatory.

However it seems odd to have photos of other people from other teams on your team site, unless you are in those photos as well. A bit of a confusing misrepresentation. But if you want to post photos of yourself taken at an event, more power to ya!

As for the individuals in the photos - well, that's a personal matter. But as far as AP is concerned - whatever!

I just can't get over the fact that they used Mulisha not Militia. I mean seriously?

'Militia' gives a negative connotation like they are a bunch of whackos running around shooting guns wildly in the forest and wating to take on the Gov. (Especially with whats been popping up recently)
It's just safer to go with 'Mulisha' since the clothing style Metal Mulisha has made it more visually acceptable.

That's my opinion anyway.
